MJSOC Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between Maxsys International Incorporated, a 501(c)(3) charitable organization registered in California, with its principal place of business at 1968 S. Coast Hwy #5786, Laguna Beach CA 92651, operating the MJSOC website ("MJSOC," "we," "us," or "our"), and you ("User" or "you"). Maxsys International Incorporated developed and hosts the mjsoc.org web application. These Terms govern your access to and use of the MJSOC website located at https://mjsoc.org (the "Site"), including all content, features, and services offered through the Site.

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site.

2. About MJSOC

mjsoc.org is a project conceived and developed by Shine Mathew and is operated to foster connections and community among young generations of Malankara Jacobite Syriac Orthodox Christians. The project is operated from the office of MJSOC (Malankara Jacobite Syriac Orthodox Community) located at Oushadhi Jn, Madaparambil Arcade, Perumbavoor, Kochi, Kerala, India.

Please be advised that mjsoc.org is an independent community initiative led by members of the community, including Mr. Shine Mathew, who identified a need for this social platform. This project has no official affiliation with or endorsement from the Malankara Jacobite Syriac Orthodox Church or any other religious groups or offices. It is a project of Maxsys International Incorporated, a 501(c)(3) charitable organization, aimed at supporting the community through digital connection.

3. User Eligibility

You must be at least 18 years of age to use the Site. By using the Site, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms. By using the Site, you also represent that you are a member of or affiliated with the Malankara Jacobite Syriac Orthodox Christian community, and that you are using the site for purposes consistent with its community-focused mission.

4. Account Registration and Security

  • Account Creation: To access certain features, you may need to register for an account. You agree to provide accurate and complete information during registration and to update your information to keep it current.

  • Account Security: You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

  • Account Responsibility: You are solely responsible for all activities conducted through your account, whether authorized by you or not.

  • Account Suspension/Termination: We reserve the right to suspend or terminate your account at any time, with or without cause, and without prior notice, for violations of these Terms or for any reason at our sole discretion.

5. Acceptable Use and Community Guidelines

Your use of the Site is subject to the following acceptable use guidelines and community standards (the "Community Guidelines"), which are incorporated into these Terms:

  • Respectful Conduct: Treat all users with respect and courtesy. Harassment, bullying, hate speech, discrimination, personal attacks, and offensive language are strictly prohibited.

  • Lawful Use: You agree to use the Site in compliance with all applicable laws, regulations, and these Terms. You will not use the Site for any illegal, unlawful, or unauthorized purpose.

  • Relevant Content: Post and share content that is relevant to the MJSOC community and its purpose as a social connecting platform for Malankara Jacobite Syriac Orthodox Christians. Avoid spam, unsolicited advertising, and off-topic content.

  • Truthfulness and Accuracy: Share information that is truthful and accurate to the best of your knowledge. Do not intentionally spread misinformation, false rumors, or misleading content.

  • Privacy of Others: Respect the privacy of other users. Do not share private information of others without their explicit consent. Do not solicit personal information from minors.

  • Intellectual Property Respect: Respect the intellectual property rights of others. Do not infringe upon copyrights, trademarks, or other proprietary rights.

  • No Impersonation: Do not impersonate any other person or entity or misrepresent your affiliation with any person or entity.

  • No Disruptive Behavior: Do not engage in any activity that disrupts the operation of the Site or the enjoyment of the Site by other users, including spamming, flooding, hacking, or introducing viruses or malware.

  • No Commercial Use (Without Permission): The Site is primarily intended for non-commercial, community-building purposes. Commercial use, such as advertising or soliciting business, is generally prohibited without our express written permission.

Enforcement: We reserve the right to monitor User Content and activity on the Site to ensure compliance with these Community Guidelines and Terms. We have the right, but not the obligation, to remove or modify User Content, suspend accounts, or take other actions we deem appropriate in our sole discretion to enforce these guidelines and maintain a positive community environment.

6. User Content and License

  • User Content Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you have all necessary rights to grant the licenses in this section to your User Content and that your User Content complies with these Terms and Community Guidelines.

  • License to MJSOC: By posting User Content on the Site, you grant Maxsys International Incorporated a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content on the Site and in connection with the services provided by MJSOC. This license is necessary for us to operate the community platform and display your content to other users.

  • Content Moderation: We reserve the right, but not the obligation, to review, monitor, edit, or remove User Content at our sole discretion, for any reason, including if it violates these Terms or is otherwise objectionable. We are not responsible for User Content and do not endorse any opinions expressed within it.

  • No Endorsement: MJSOC does not endorse any User Content and is not responsible for the accuracy, legality, or appropriateness of any User Content.

7. Intellectual Property Rights

  • Site Ownership: The Site and its original content, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software) are owned by Maxsys International Incorporated or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

  • Limited License to Use Site: We grant you a limited, non-exclusive, revocable license to access and use the Site for your personal, non-commercial use, in accordance with these Terms.

  • Restrictions: You may not modify, reproduce, distribute, create derivative works of, publicly display, or in any way exploit any of the Site's content, in whole or in part, except as expressly permitted by MJSOC or applicable law (e.g., fair use).

  • Trademarks: MJSOC logos and names are trademarks of Maxsys International Incorporated. You may not use these trademarks without our prior written permission.

8. Third-Party Links and Services

The Site may contain links to third-party websites, services, or content that are not owned or controlled by MJSOC. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. You access and use third-party links and services at your own risk, and you should review the terms and privacy policies of those third parties.

9. Disclaimer of Warranties

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MAXSYS INTERNATIONAL INCORPORATED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE SITE OR ANY CONTENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAXSYS INTERNATIONAL INCORPORATED, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, OR ANY USER CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE AMOUNT YOU HAVE PAID TO US, IF ANY, IN THE PAST TWELVE (12) MONTHS, OR IF NO PAYMENTS HAVE BEEN MADE, THE SUM OF FIFTY U.S. DOLLARS ($50).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES, SO SOME OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to indemnify, defend, and hold harmless Maxsys International Incorporated, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Site; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

12. Termination

We may terminate or suspend your access to the Site and your account, with or without cause, at any time, and without prior notice or liability. Upon termination, your right to use the Site will cease immediately. Sections of these Terms that by their nature should survive termination (including, without limitation, Intellectual Property Rights, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and General Provisions) will survive any termination.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any legal suit, action, or proceeding arising out of or relating to these Terms or the Site shall be instituted exclusively in the state or federal courts located in Los Angeles County, California, and you irrevocably submit to the personal jurisdiction of such courts. You waive any objection to venue in such courts.
